In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), Bidari informs that it is the owner of the website. In accordance with the requirements of Article 10 of the aforementioned Law, Bidari provides the following details:

User and liability regime

The navigation, access, and use of the Bidari website confers the status of user.

The Bidari website provides a great diversity of information, services, and data. The user assumes responsibility for the correct use of the website. This responsibility will extend to:

• The truthfulness and legality of the information provided by the user in the forms provided by Bidari for access to certain content or services offered by the website.
• The use of the information, services, and data offered by Bidari contrary to the provisions of these conditions, the Law, morality, good customs or public order, or that in any other way may entail harm to the rights of third parties or to the proper functioning of the website itself.

Links policy and disclaimers

Bidari is not responsible for the content of the websites that the user may access through the links established on its website, as long as it does not have effective knowledge that the activity or information to which it refers or recommends is illicit or harms the assets or rights of a third party that are subject to compensation, or, in the event that it does have such knowledge, acts diligently to remove or disable the corresponding link.

It will be understood that Bidari has the effective knowledge referred to in the previous paragraph when a competent body has declared the data unlawful, ordered its removal or made access to it impossible, or the existence of the harm has been declared, and Bidari was aware of the corresponding resolution, without prejudice to the content detection and removal procedures that Bidari applies by virtue of voluntary agreements and other means of effective knowledge that may be established.

Bidari declares that it has adopted all the necessary measures to avoid any damage to the users of its website that may arise from browsing its website. Consequently, Bidari is not responsible, under any circumstances, for any potential damages that the user may suffer from browsing the Internet. Likewise, it will not guarantee the technical availability, accuracy, truthfulness, validity, or legality of sites not owned by it that can be accessed through the links.

Modifications

Bidari reserves the right to make the modifications it deems appropriate, without prior notice, to the content of its website. This applies both to the contents of the website and to the conditions of use thereof, or to the general terms and conditions of business. The changes referred to in this section will not affect contracts made before the date of their publication.

Said modifications may be made through its website by any legally admissible means and will be binding during the time they are published on the website and until they are validly modified by subsequent ones.

Pricing information

In the event that prices for products and/or services are displayed, those shown on screen will be the ones in force at all times. Prices will be indicated in euros and will include the Value Added Tax (VAT). In the event that VAT is not included in the price, it will be expressly indicated, and the user will be able to view the full final price.

Likewise, if any other tax is applicable, it will also be indicated, including, where appropriate, the amount of any increases or discounts that apply to the offer and any additional costs that may be passed on to the consumer or user.

Intellectual and industrial property

Bidari, either on its own or as an assignee, is the owner of all intellectual and industrial property rights of its website, as well as of the elements contained therein (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by Bidari. Consequently, they are works protected as intellectual property by the Spanish legal system, and both Spanish and EU regulations in this field, as well as international treaties on the matter signed by Spain, are applicable to them.

By virtue of the provisions of the Intellectual Property Law, the reproduction, distribution and public communication, including the method of making them available, of all or part of the contents of this website, for commercial purposes, on any medium and by any technical means, without the authorization of Bidari, are expressly prohibited.

The user undertakes to respect the Intellectual and Industrial Property rights owned by Bidari. They may view the elements of the portal and even print, copy and store them on their computer’s hard drive or on any other physical medium, provided that it is, solely and exclusively, for their personal and private use. The user must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the Bidari pages.

Legal actions, applicable legislation, and jurisdiction

Bidari reserves the right to file any civil or criminal actions it deems appropriate for the improper use of its website and content, or for the breach of these conditions.

The relationship between the user and the provider will be governed by the current and applicable regulations in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to the ordinary courts, complying with the rules on jurisdiction and competence in this regard.
